Résumé: الملخص: : لقد شغل موضوع المسؤولية الدولية الجنائية فقهاء القانون الدولي الجنائي، لما له من أثر بالغ على منظومة الحقوق للمجتمعات الإنسانية، التي يفترض أن يتمتع بها أشخاص القانون الدولي العام من دول و أفراد و منظمات. و هذه الأخيرة تعتبر من الفـاعلين الدوليين الذين يسري عليهم خطاب قواعد القانون الدولي العـام عمـوما وخطاب قواعد القانون الدولي الجنائي خصوصا، و خاصة ما تعلق بالانتهاكات التي تقع على حقوق الإنسان سلما و حربا. و لقد حاولنا بقدر الإمكان في هذا، أن نجسد فكرة المسؤولية الدولية الجنائية واقعا يفرض على أشخاص القانون الدولي العام الوقوف عند حدوده متى استدعت الضرورة ذلك، برغم الاختلافات الفقهية في هذا الشأن، حول فرض المسؤولية الجنائية على أشخاص القانون الدولي العام من عدمه. و هي مسألة في اعتقادنا لا زالت قيد البحث والتمحيص، اللهم ما تعلق منها في جانبها المادي الموضوعي، أما ما تعلق في جانبها الشكلي الإجرائي فلا زالت بعض المعوقات تحول دون تجسيد و إثبات هذا النوع من المسؤوليـات مثلمـا سنشير إليـه في هذا المقـال، و هو أمـر قوض من مسـألة حمـاية و تعزيـز و ترقية منظومة حقوق الإنسان في كل الأزمنة و الأمكنة، بما يحقق مقاصد و مبادئ الأمم المتحدة.
