الاختصاص النوعي لقاضي تنفيذ مسائل الأحوال الشخصية في دولة الإمارات

Résumé: تنعدم قيمة الأحكام والأوامر والقرارات القضائية ما لم تُنفذ، فالتنفيذ هو الهدف الأساسي من الدعاوى؛ لذلك تنتهج الدول طريق تخصيص أحد القضاة لإتمام إجراءات التنفيذ، وتحّد اختصاصاته. والأمر كذلك بالنسبة للمشرع في دولة الإمارات. ونظراً لأهمية مسائل الأحوال الشخصية على وجه التحديد باعتبارها تمس نواة المجتمع، خصّص المشرع الإماراتي قاضي متخصص بتنفيذ مسائل الأحوال الشخصية، وحدّد في اللائحة التنظيمية رقم 57 لسنة 2018 وتعديلاتها اختصاصات ذلك القاضي النوعية، وجاء بعضها الزاميا، وبعضها الأخر جوازياً أو اختيارياً. صدرت فيما بعد قرارات أو أدلة إرشادية من بعض إمارات الدولة فيها بعض القواعد المتعلقة بتنفيذ مسائل الأحوال الشخصية، وتضمنت قواعد في بعضها مخالفة لما ورد في الاختصاص النوعي لقاضي تنفيذ مسائل الأحوال الشخصية الوارد في اللائحة – سالفة الذكر – كما أدت إلى حصول بعض المتقاضين على امتيازات لا يحصل عليها أخرون بحسب مكان التنفيذ في أي إمارة ولأي قرار أو دليل يخضع. The value of judgments, decisions and judicial orders lies in their final stage of execution. Therefore, states work to allocate a judge to implement judgments, decisions and orders issued by the judiciary. The legislator in the UAE took the same approach, and in view of his concern for the family, a specialized judge was assigned to personal status matters to implement them. He defined his specific terms of reference in Regulation No. 57 of 2018 and its amendments. Subsequently, some emirates of the state issued regulatory and guiding manuals, some of their rules pertaining to the specific jurisdiction of the execution judge, and some of them contained a violation of what was stated in the aforementioned list. Some of them led to a distinction between litigants according to the emirate in which the execution takes place.
