النظام التأديبي بين التشريع الوظيفي وقانون العمل في الجزائ-ر – دراسة مقارنة

Résumé: الخطأ التأديبي ىو كل إختلال بالقيام بالواجبات التي تقتضي سن سير انتظام واستم ا رر العمل داخل المؤسسة وكذلك الامتناع عن كل ما من شأنو إلحاق الضرر بالمشروع أو عرقمتو لتحقيق الأىداف التي خصص من أجميا إذ يعد الأساس الذي تقوم عمو العقوبة التأديبية، وىذه الأخيرة تخضع لضوابط فعالة نتيجة ىيمنة مبدأ الشرعية عمييا ولذلك تضطر السمطة الرئاسية إلى استعمال سمطة موازية لسمطة التأديب والتي لا تنتمي إلى التأديب لأنيا تعرف بسمطة العقاب. كما أن الموظف والعامل يتمتعان بمجموعة من الضمانات وذلك في مواجية السمطة الرئاسية عن طريق الإطلاع عمى الممف التأديبي، الإستعانة بمدافع أثناء مرحمة التحقيق كما يجب عمى الإدارة والمستخدم تسبيب الق ا رر التأديبي وذلك قصد معرفة تناسب الق ا رر المتخذ في حق الموظف أو العامل يتناسب والخطأ المقترف .Disciplinary error is every failure to perform the duties that require the enactment of regularity and continuity of work within the institution, as well as refraining from everything that would harm the project or obstruct it to achieve the goals for which it was allocated, as it is the basis on which the disciplinary punishment is based, and the latter is subject to effective controls as a result of the dominance of The principle of legitimacy is imposed on it, and therefore the presidential authority is forced to use an authority parallel to the disciplinary authority, which does not belong to discipline because it is known as the punishment authority. In addition, the employee and the worker enjoy a set of guarantees in the face of the presidential authority by examining the disciplinary file, seeking the help of a defender during the investigation stage, and the administration and the employee must give reasons for the disciplinary decision, in order to know the proportionality of the decision taken against the employee or worker commensurate with the error committed.
