سلطة الزوجة في فك الرابطة الزوجية – بين الحق والتعسف – في ضوء قانون الأسرة الجزائري والفقه الإسلامي

Résumé: يهدف هذا المقال إلى إبراز السلطة الممنوحة للزوجة في فك الرابطة الزوجية، فهي تتمتع بحق التطليق الذي يستند إلى أحد المبررات الشرعية التي جاءت بها المادة 53 من قانون الأسرة، إلى جانب الخلع الذي يتم وفقا للمادة 54 دون رضا الزوج مقابل أن تدفع له عوضا يسمى بـبدل الخلع يتفق عليه الطرفان وعند عدم الاتفاق يتولى القاضي تقديره. إلا أن سلطة الزوجة في التطليق تكاد تكون مقيدة بالحالات المنصوص عليها في المادة 53، وبالتالي يعتبر خروجها عنها تعسفا يهدف للإضرار بالزوج، الأمر الذي يختلف عنه في الخلع إذ لا يشترط القانون موافقة الزوج عليه ولا يتعدى رضاه الاتفاق على قيمة مقابل الخلع الذي يتدخل القاضي لتحديده في حالة النزاع، فيكون مركز الزوج والأسرة في خطر الزوال كلما عقدت الزوجة نيتها في إيقاع الخلع. كلمات مفتاحية: الزوجة؛ فك الرابطة الزوجية؛ التطليق؛ الخلع؛ الأسرة Abstract : The purpose of this article is to highlight the power granted to the wife to dissolve the marital union.
