أحكام الفساد والبطلان في قانون الأسرة الجزائري (الوصية نموذجا)
Résumé: يعالج موضوع المذكرة الوصية، هذه الأخيرة خصتها الشريعة الإسلامية و من ثم القانون بالتنظيم المحكم و المفصل لأحكامها . و بالرغم من أن للإنسان حق الايصاء بأمواله حال حياته، إلا أن وصيته مقيدة بضوابط شرعية و قانونية بهدف عدم المساس بحق الورثة بترك زمام الوصية تحت إرادة المورث يتصرف فيها كما يشاء ، تتمثل في عدم جواز الايصاء لوارث، و عدم جواز تجاوز الموصى به ثلث التركة فيما عدا إجازة الورثة لما يخالف هذه الحدود، و ذلك لضمان عدم المساس بما جاء به الشارع الحكيم من توزيـع عادل للتركة إذا منـحت الحرية للمورث في التصرف فيها بما يلحق الضرر ببعض الورثـة أو كلهم . The summary: The subject of the memorandum addresses The Will which is targeted by Islamic law and the law for control its provisions. Even though any person has the right to recommend his money alive. However, his will is constrained by legitimate and legal controls to avoid undermining the right of the heirs. It's not allowed that recommending for a heir, or The recommendation exceeded one third of the estate only if the heirs allow it All this, only to ensure that the distribution of the estate is not compromised.
