الأمراض الوراثية وأثرها في حكم تحديد النسل -دراسة فقهية مقاصدية- -genetic Diseases And Their Impact On The Rule Of Birth Control -juristic And Objective Study

Résumé: ملخص البحث: تطرقت في هذا البحث إلى بيان حقيقة تحديد النسل والأمراض الوراثية. وبعد الدراسة الفقهية توصلت إلى أنه لا يمكن إرساء الحكم الشرعي إلا بمراعاة وسيلة تحديد النسل مع درجة خطورة الأمراض الوراثية. فيحرم -مطلقا- اللجوء إلى الخصاء كوسيلة لتحديد النسل لتفادي الأمراض الوراثية. كما يحرم اللجوء إلى التعقيم كوسيلة لتحديد النسل لتفادي الأمراض الوراثية البسيطة والقابلة للعلاج. وبالمقابل فإنه يجوز اللجوء إلى التعقيم كوسيلة لتحديد النسل لتفادي الأمراض الوراثية شديدة الخطورة التي تؤدي إلى الوفاة. وأما اللجوء إلى التعقيم لتفادي الأمراض الوراثية الشاقة والمزمنة، فإنه لا يجوز ابتداء بل لا بد من الزواج، وإنجاب عدد من الأطفال، فإن كان الغالب عليهم الإصابة بهذه الأمراض، واستنفذت جميع الوسائل الممكنة التي لا تقطع الحمل نهائيا، كالاستعمال المستمر لوسائل منع الحمل المؤقت، فإنه يجوز حينئذ. Abstract :In this research, I have explained the fact of birth control and genetic diseases. After the jurisprudential study, I concluded that the legal ruling can only be established by taking into account the method of birth control with the degree of severity of hereditary diseases. It is absolutely forbidden to resort to castration as a method of birth control to avoid genetic diseases. It is also forbidden to resort to sterilization as a method of birth control to avoid simple and treatable genetic diseases. On the other hand, sterilization may be used as a method of birth control to avoid severe genetic diseases that lead to death. As for resorting to sterilization to avoid arduous and chronic genetic diseases, it is not permissible in the beginning, but it is necessary to marry, and to have a number of children, if they are predominantly infected with these diseases, and exhausted all possible means that do not cut off pregnancy permanently, such as the continued use of temporary contraceptives, then it is permissible.
