علم الضحية )مفهوم جديد في العلوم الجنائية( و أين موقع المشرع الجزائري من دلك؟

Résumé: ملخص البحث: هدف البحث إلى التعريف بعلم الضحية كمفهوم جديد في العلوم الجنائية. وتبين من استعراض هذا المفهوم أهمية دور الضحية في تفشي السلوك الإجرامي من جهة، وكيفية الوقاية من الجريمة من جهة أخرى. وتتحدد حداثة هذا المفهوم من خلال إضافة ركن الضحية إلى أركان الجريمة، بعدما كانت التشريعات الجنائية تولي اهتماما بالمجرم، الجريمة والسياسة الجنائية. وعلى سبيل المثال فالمشرع الجزائري قد أهمل ركن الضحية وما لدوره في شرعية التجريم، العقاب، والمتابعة الجزائية. وقد تبين من خلال استعراض بعض النماذج النظرية أن لعلم الضحية وارتباطه بالسلوك الإجرامي دور كبير في الوقاية من الجريمة. Abstract: The research aimed to define victimology as anew notion in penal sciences, it was clear from this definition the importance of the role of the victim in the prevailing of the criminal behavior on one side. On the other side the prevention of the crime. This notion is new in terms of the addition of the principle of the victim to the other principles of the crime. After a long time the penal legislation give a great importance to the criminal, the crime and the penal policy. As an example, The Algerian legislator has neglected the principle of the victim and his role in the penal legitimacy, it is clear from showing some theoretical types that victimology and its relation with the criminal behavior plays a great role in the prevention of the crime.
