السياسة الجزائية الإجرائية للمشرع الجزائري في مجال مكافحة جريمة الفساد

Résumé: الملخص: لقد صار اليوم رهان مكافحة الفساد تحديا حقيقيا أمام مختلف الدول، الأمر الذي دفع بالمجتمع الدولي إلى وضع إستراتجيات لمكافحة الفساد كأحد أولوياته، لتكلل جهوده بإصدار الاتفاقية الأممية لمكافحة الفساد، التي انضمت إليها الجزائر، وهو ما حدا ببلادنا إلى القيام برزمة من الإصلاحات التشريعية بهدف تحجيم الظاهرة، وقصد تحقيق أغراض العدالة الجزائية قامت العديد من الدول بإيجاد جملة من الأحكام الجزائية الخاصة بجرائم الفساد باعتبارها نوع من الإجرام المنظم، والتي مقتضاها وضع إستراتجية وسياسة إجرائية خاصة تتضمن الخروج عن النطاق التقليدي للقوانين الإجرائية الجزائية والتخفيف من حدة بعض المبادىء والتي مقتضاها عدم المساس بالحقوق والحريات العامة، وهذا لغرض الكشف عن الحقيقة، وتتعلق هذه الإجراءات بمرحلتي البحث والتحري والتحقيق القضائي. :Abstract Today, the fight against corruption has become a real challenge for various countries, which led the international community to put anti-corruption stratégies as one of its priorities, culminating in its efforts to issue the UN Convention against Corruption, to which Algeria has acceded, which led our country to undertake a package of législative reforms in order to curtail In order to achieve the objectives of criminal justice, many countries have established a number of penal provisions for corruption offenses as a form of organized crime, which necessitated the développement of a special stratégie and procédural Policy That includes deviating from the traditionnel scope of procédural laws.
