مراحل إخلال الغير بالعقد

Résumé: عالجت هذه الدراسة أهم حالات مسؤولية الغير عن الإخلال بالعقد، فالقانون يقرر مسؤولية أطراف العقد إذا لم ينفذ أحدهم هذه الالتزامات أو قام بفعل من شأنه الإخلال بهذا العقد، ولكن إذا قام أحد الأشخاص من خارج النطاق الشخصي لهذا العقد (الغير) بالإخلال به، أي القيام بأي فعل أو تصرف من شأنه عرقلة أداء العقد من أولى مراحل نشوئه إلى تنفيذه، فيعد مسؤولاً رغم كونه خارج نطاق هذا العقد. ولقد اتبعنا في هذه الدراسة المنهج التحليلي المقارن بين القانون المدني العراقي والقانون المدني الفرنسي، وقمنا بإبراز أهم التعديلات الجوهرية في القانون المدني الفرنسي الجديد فيما يتعلق بموضوع الدراسة وذلك للاستفادة منها في تحسين الموقف في القانون العراقي. وذلك من خلال تقسيم الدراسة على ثلاثة مطالب.This studyaddressed the most important aspects of liability of third party for breach of contract, the lawdetermines the responsibility of the parties to the contract if one of themdid not implementthese obligations or didsomethingthatwouldbreachthiscontract, but if someonefromoutside the personal scope of thiscontractbreached the contract, i.e. Anyact or behaviorthatwouldhinder the performance of the contractfrom the earliest stages of itsdevelopmentuntilitsimplementation, soitisconsideredresponsibleeventhoughitisoutside the scope of thiscontract. We have used in thisstudy the analyticalapproachcomparing the Iraqi civil law and the French civil law, and we have highlighted the most important fundamentalamendments in the new French civil lawregarding the subject of the study in order to benefitfromit in improving the situation in Iraqi law.
