Résumé: الصفقات العمومية باعتبارها عقود تتم بالتقاء إرادتين في شكل إيجاب و قبول مطابق له، غير أن ما يميزها هو أن أحد أطرافها جهة تعرف في فرنسا بالمشتري العمومي تستخدم أموالا عامة. وإذا كان الأفراد كأصل عام أحرار في كيفية التعبير عن إرادتهم في التعاقد، فإنه على النقيض من ذلك نجد أن القوانين المنظمة للصفقات العمومية تقيد حرية الإدارة في ذلك بوجوب إتباع أساليب معينة للوصول لأفضل العروض بأقل الأثمان وبما أن أسلوب طلب العروض يحقق أكبر قدر من المنافسة والشفافية، نجد أن قانون الطلب العمومي الفرنسي قد تبناه ونظم أحكامه كإطار يتم من خلاله تبادل الإيجاب والقبول لإبرام الصفقة.Public contracts are conclusion between two willing parties.
