المسؤولية المدنية الناجمة عن تلوث البيئة

Résumé: أصبح التلوث البيئي آفة العصر لما له من آثار ضارة على الإنسان والكائنات الأخرى الأمر الذي يؤدي إلى تدهور البيئة وإفسادها واختلال توازنها البيئي، وأمام هذا الوضع تبدو الحاجة ملحة لتقرير مسؤولية الفاعل وإجباره على التعويض، وهذا يدعو إلى مواجهة آثار التلوث في إطار المسؤولية المدنية عن أضرار تلوث البيئة، وتكمن أهم إشكالات المسؤولية المدنية عن أضرار التلوث، في تحديد الأساس القانوني لهذه المسؤولية، فهل تقوم على الخطأ أم تقوم على الضرر؟ومن هذا المنطلق تأتي هاته الدراسة لتبين كيف يمكن حماية البيئة من الأضرار التي يسببها التلوث من خلال إعمال قواعد المسؤولية المدنية عن تلك الأضرار. Environmental pollution has become the scourge of our times due to its harmful effects on human beings and other organisms, leading to its degradation, corruption and imbalances. Faced with this situation, it seems urgent to determine the liability of the offender and to compel him to compensate, which implies tackling the effects of pollution within the framework of civil liability for environmental pollution damage. The most important problem of civil liability for pollution damage lies in determining the legal basis of this liability: is it based on fault or damage? It is in this spirit that this research paper comes to show how the environment can be protected from damage caused by pollution by applying the rules of civil liability for such damage
