فقه الإمام خليل من خلال مختصره الفقهي

Résumé: يهدف هذا البحث إلى إنعام النظر في طريقة فقهية فريدة سار عليها المختصرون في المذهب المالكي؛ وهو ما اصطلح عليه بمصطلح: فقه النظائر؛ وهذا المنحى الفقهي يعد ظاهرة في المختصرات الفقهية، فجاءت فكرة البحث لتوسيع النظر وبسط الفكر فيها، وجعلنا مختصر خليل النموذج لما له في المذهب من مكانة علمية عالية؛ إذ هو عمدة المفتين وبغية الدارسين؛ وبيان ذلك أن معرفة النظائر أهم مدرك من مدارك التقعيد الفقهي، ومن خلال هذا البحث يرد على من زعم الجمود في المختصرات، وأنها مجرد ألفاظ وألغاز وأقفال أكثر عناء وأقل غناء، بل إنها تعد منجما ثريا وثروة غنية لتحصيل الملكة الفقهية والصنعة على التنظير والتخريج؛ وللتأكد من أصالة وأهمية هذا المنحى الفريد في عرض الفروع وبسط الأفكار. Abstract: This research aims to carefully consider a unique jurisprudential method followed by the abbreviations in the Maliki doctrine, which was termed by the term: jurisprudence of isotopes, and this jurisprudential trend is a phenomenon in jurisprudential abbreviations, so the idea of the research came to expand consideration and simplify thought in it, and made us abbreviated Khalil model because of his high scientific status in the doctrine, as it is the mayor of the muftis and for the sake of scholars; He claimed that the abbreviations are inertia, and that they are just words, riddles and locks that are more troublesome and less rich, but that they are a rich mine and rich wealth to obtain the faculty of jurisprudence and workmanship on theorizing and graduation, and to ensure the originality and importance of this unique trend in the presentation of branches and the simplification of ideas.
