حماية الملكية الفكرية وفقا للتجربة الجزائرية والاتفاقيات الدولية

Résumé: إن حماية الملكية الفكرية من الممارسات غير القانونية سواء على مستوى التجربة الجزائرية أو الاتفاقيات الدولية قد أصبح ضرورة حتمية وذلك لاتخاذ مختلف الإجراءات خصوصا في ظل تقنية الرقمنة والانترنيت، من أجل الاستفادة من المنافع التي تنتج عن تلك الحماية وأهمها ضمان ملكية المبتكر أو المخترع أو المنتج لذلك الابتكار والاستفادة منه تجاريا، وعدم استخدامه إلا بالتزامات تعاقدية، وهذا ما يوفر الحافز الذي يدفع المؤسسات والأفراد على استثمار الوقت والموارد في تشجيع الابتكار ونشر المعرفة، تم التوصل إلى أن الجزائر تسعى مثل سائر دول العالم جاهدة لتبني قوانين حماية الملكية الفكرية الهادفة إلى إيقاظ روح الإبداع والابتكار والحفاظ على الإنتاج الفكري والتقني للعلماء والمخترعين، وفق مع ما جاءت به الاتفاقيات الدولية لحماية الملكية الفكرية من مبادئ خصوصا في ظل المنظمة العالمية للملكية الفكرية. Protecting intellectual property from illegal practices, whether at the level of the Algerian experience or international agreements, has become an absolute necessity to take various measures, especially in light of digital technology and the Internet, in order to benefit from the benefits resulting from this protection, the most important of which is ensuring the ownership of the innovator, inventor or producer of that innovation and benefiting from it commercially, and not using it except under contractual obligations. This provides the incentive that drives institutions and individuals to invest time and resources in encouraging innovation and spreading knowledge. It was concluded that Algeria, like all countries of the world, is striving to adopt intellectual property protection laws aimed at awakening the spirit of creativity and innovation and preserving the intellectual and technical production of scientists and inventors, in accordance with the principles of international agreements to protect intellectual property, especially in light of the World Intellectual Property Organization.
