حرية الممارسة النقابية في الجزائر بين النص والتطبيق
Résumé: الملخص: يعتبر الحق النقابي من الحقوق الأساسية المكرّسة في الدساتير الجزائرية، غير أنّ واقع حرية الممارسة النقابية في الجزائر أصبح محلّ عديد التساؤلات حول حقيقتها من الناحيتين القانونية والعملية وما يؤكد ذلك الزيارات المتكرّرة للجنة رفيعة المستوى التابعة لمكتب العمل الدولي بمناسبة الشكاوى المقدمة من قبل تنظيمات نقابية مختلفة، تدعي أنّ الإدارة ممثلة في الحكومة الجزائرية تخنق أو تعرقل أو تمنع ممارسة الحق في الحرية النقابية ضمن إطاره القانوني الدولي الصحيح. Abstract:The trade union (labor union) right is one of the basic rights enshrined in the Algerian constitutions. But, the reality of freedom of trade union practice in Algeria has been questioned about its reality, both legally and practically. This is confirmed by the frequent visits of a high-level committee of the International Labor Office due to complaints submitted by various trade union organizations. They claim that the administration represented by the Algerian government stifles, obstructs or prevents the exercise of the right to freedom of association within its proper international legal framework.
