دور السلطات الضابطة للقطاعات الشبكية في تفعيل مبدأ حرية المناقسة

Résumé: الجزائر بتكريسها سياسة الانفتاح الليبرالي والعزوف عن سياسة الاحتكار للقطاعات الشبكية، استبدالت أسلوب الإدارة المباشرة للمرافق والخدمات العمومية بأسلوب جديد يقوم على تفويض مهام الضبط والتأطير لهيئات ضابطة جديدة، تتمثل في السلطات الإدارية المستقلة أو ما يعرف باسم سلطات الضبط القطاعية أوكلت لها مهمة السهر على احترام السير الحسن للنشاط المعني وضبطه تقنيا واقتصاديا، سواء قبل مباشرته أو أثناء القيام به والسهر على فك النظام الاحتكاري والانتقال إلى نظام تنافسيي. بإخضاع المرفق العام لقواعد المنافسة، أصبح الضبط القطاعي لمرفق الشبكي كميكانيزم للانفتاح على المنافسة عن طريق إرساء سلطة ضبط قطاعية تتكفل بوظيفة الموازنة بين أهداف المنافسة ومبادئ المرفق العام، وتخدم دور الدولة الجديدة المتوجه أساسا نحو مهام السلطة العمومية والتنظيم بدلا من مهام التسيير الإداري، مما يجعل الهيئات الضابطة تلعب دورا هاما في تفعيل مبدأ المنافسة الحرة في القطاعات المرفقية. Algeria, by devoting a policy of liberal openness and reluctance monopoly policy, she replaced the method of direct management of public utilities and services by a new method it’s based on delegating regulatory tasks and framing for new regulator authorities, represented by the independent administrative authorities or what is known as sectoral regulatory authorities have been entrusted with the task of ensuring respect for the good functioning of the activity in question and its technical and economic control, whether before starting it or while doing it and ensuring the dismantling of the monopolistic system and the transition to a competitive system. By subjecting the public service to the rules of competition, the sectoral regulatory of the network service has become a mechanism for opening up to competition by establishing a sectoral regulatory authority that undertakes the function of balancing the objectives of competition and the principles of the public service, and serves the role of the new state, which is directed mainly towards the tasks of public authority and organization rather than the tasks of administrative management, making the regulator authorities plays an important role in activating the principle of free competition in the network sectors.
