خصوصية التعاقد باستخدام الوسائل الإلكترونية في القانون الجزائري

Résumé: أدى التقدم المتلاحق خلال السنوات الأخيرة في مجال المعلومات والاتصالات باستخدام الوسائل الإلكترونية، إلى تحول جذري في نمط الحياة بشكل عام والحياة القانونية بشكل خاص، إذ يلاحظ أثره في كيفية وطريقة إبرام العقود حيث كثر التعاقد باستخدام الوسائل الإلكترونية. فبرزت الحاجة إثر ذلك، إلى تضمين التشريعات الحديثة تنظيما محكما وخاصا بالمعاملات الإلكترونية التي تنفرد بجملة من الخصوصيات مقارنة بالمعاملات القانونية التقليدية، فضلا على كون النظرية العامة للعقد قد لا تكفي لمواجهة بعض الإشكالات التي أفرزها شيوع استخدام الوسائل التكنولوجية في التعاقد. Abstract: The successive progress in recent years in the field of information and communication using electronic means has led to a radical transformation in the lifestyle in general and legal life in particular, as its effect is noticed in the manner and method of concluding contracts, as there has been a proliferation of contracts using electronic means. As a result, the need arose to properly organize modern legislation, especially for electronic transactions, which are unique to a set of peculiarities compared to traditional legal transactions, in addition to the fact that the general theory of the contract may not be sufficient to address some of the problems created by the widespread use of technological means in contracting
