قضايا النفقة والحضانة في المغرب الأوسط من خلال نوازل الونشريسي

Résumé: جاء موضوع دراستنا حول قضايا النفقة والحضانة في المغرب الأوسط من خلال نوازل الفقيه أبو العباس أحمد بن يحى الونشريسي المتوفى ( 914 ه / 1508 م ) ، من خلال كتابه المعيار المعرب والجامع المغرب عن فتاوى أهل افريقية والأندلس والمغرب ، حيث أورد فيه عددا مهما من النوازل التي تتعلق بالأسرة والأحوال الاجتماعية التي لها دور في معرفة أحوال المجتمع في الفترة(4 - 9ه / 10 -15 م) واستطاع من خلال جمعه وتأليفه لكتابه أن يكون له قيمة مادية وعلمية ويعتبر وثيقة ومصدر للمعلومات القيمة بالمجال التاريخي والاجتماعي وخاصة الجانب الديني الذي مكن للمذهب المالكي بالمغرب الأوسط باعتباره أحد فقهائه،حيث بينت نوازله العديد من المشاكل الأسرية في مجال النفقة والحضانة التي كانت موضوع دراستنا،حيث عالجت جوانب اجتماعية وحتى تاريخية من خلال ما استنتجناه من حل لهذه القضايا الأسرية وما نتج عنها من ظروف وأحوال للفرد داخل أسرته ومجتمعه وكذلك إشكالية معالجة هذه الظواهر المستحدثة وجبت فيها اجتهاد رجال الفقه المالكي. و لذلك اعتمدنا المنهج التاريخي واتبعنا المنهج التحليلي عند تتبع بعض القضايا وشرح وتحليل ونقد الأفكار واستخراجها من نصوص النوازل وتوظيفها بما يخدم السياق التاريخي , حيث توصلنا الى مجموعة من الأحوال التي تحكمت ببناء الأسرة اجتماعيا وثقافيا في العصر الوسيط. The subject of our study on maintenance and custody issues in the Central Maghreb came through Nawazel al-Faqih Abbas Ahmed bin Yahya al-Oncherisi, the deceased (914 AH/1508 CE), through his book Al-Maqyar Al-Maarab and Al-Jami 'al-Maghrib on the fatwas of the people of Afriqiyah, Andalusia and Morocco, in which he cited a significant number of calamities concerning the family and social conditions which have a role in knowing the conditions of society during the period 4-9 AH/10-15 AD. By collecting and writing his book, he was able to have material and scientific value and to be considered a document and source of valuable information in the historical and social sphere, especially the religious aspect that enabled Maliki in the Middle Maghreb as one of its jurists. He explained many family problems in the area of maintenance and custody, which were the subject of our study, It addressed social and even historical aspects through the resolution of these family issues and the resulting circumstances and conditions of the individual within his family and society, as well as the problem of dealing with these new phenomena, in which the jurisprudence of Maliki jurists must be diligent. We have therefore adopted the historical approach and followed the analytical approach when tracking some issues and explaining, analysing, criticizing and extracting ideas.
