جريمة ابادة قبيلة اولاد رياح عام1845

Résumé: من أجل ردع الثورة الشعبية التي قادها بومعزة، قامت القوات الفرنسية الاستعمارية في عام 1845- في منطقة الظهرة بالجزائر -بإبادة قبيلة كاملة لجأت إلى غار" الفراشيش" وذلك بناء على أمر الكولونيل " بليسي "، حيث غلّقت كل منافذ هذا الغار وأضرمت النيران ليختنق كل من كان بداخله ثم الموت حرقا. لم تكن محرقة قبيلة أولاد رياح فعلا معزولا، ذلك لأنها كانت بتشجيع وبإيعاز من الحاكم العام للجزائر آنذاك الماريشال "بيجو " الذي أمر باستخدام هذه الوسيلة الوحشية لإبادة القبيلة خنقا. تهدف هذه الدراسة إلى تحليل أحداث ووقائع محرقة الظهرة وإثارة المسؤولية الجزائية لفرنسا عن هذه الجريمة والبحث في السبل القانونية المتاحة لذلك. لقد توصلت هذه الدراسة إلى أن جريمة محرقة الظهرة هي جريمة إبادة جماعية مكتملة الأركان يمكن متابعة فرنسا بشأنها. Abstract : In order to deter the popular revolution led by Bou maza,in 1845 the French colonial forces in the Dahra- region of Algeria- annihilated a whole tribe that had sought refuge in the “Ghar al-Frashish”on the order of colonel “Pélissier”, where all the ports of this cave closed and set fire to choke everyone inside and then burned. The holocaust of the Ouled Riah tribe was not really isolated because it was encouraged and at the behest of the governor-general of Algeria, Marshal Bugeaud,who ordered the use of this brutal means to exterminate the tribe by suffocation. This study aims to analyze the events and incidents of the holocaust and raise the criminal responsibility of France for this crime and to explore the legal means available for this. This study concludes that the holocaust of “Ouled Riah” is a genocide for which France can be pursued
