نظام الخلوة الشرعية للسجين ــ دراسة مقارنة بين التشريع العقابي الإسلامي والوضعي ــ

Résumé: ملخص البحث :تشكل هذه الدراسة بحثا لموضوع نظام الخلوة الشرعية للسجين في التشريع العقابي الإسلامي والوضعي، وبالتالي فهي دراسة مقارنة لها ارتباط وثيق بموضوع حقوق السجين، حيث إنّ موضوع الحياة الجنسية للسجناء يثير جدلا كبيرا بين علماء العقاب والإجرام، وعلماء الاجتماع والنفس وعلماء القانون وفقهاء الشريعة الإسلامية، وقد بيّن الباحث من خلال هذه الدراسة مفهوم نظام الخلوة الشرعية للسجين، وأهميته في مبحث أول، ثمّ تطرّق إلى موقف كل من التشريع العقابي الإسلامي والوضعي منه في مبحث ثاني، ليصل الباحث إلى ضرورة الأخذ به وفق الضوابط الشرعية والقانونية التي تطرق إليها في المبحث الثالث.
