رقمنة التراث الثقافي: بين ضرورة التطبيق وغياب التشريع

Résumé: ملخص : اهتم المشرع الجزائري بالتراث الثقافي الوطني، وتجلى اهتمامه بإصدار القانون رقم 98-04 المتعلق بحماية التراث الثقافي 1998، حيث تضمن قواعد عامة تحدد الإطار القانوني لتثمين والمحافظة على الموروث الثقافي، إلا أنه مع التطور التكنولوجي ظهرت ما يسمى برقمنة التراث الثقافي، ما أ سفر عن خلق فراغ تشريعي في استحداث الحماية الرقمية، حيث أضحت القواعد العامة لهذا القانون عاجزة عن مسايرة التغيرات السريعة في تقنيات المعلومات، وانتقالها من المجال التقليدي إلى المجال الرقمي، الأمر الذي يدعو المشرع إلى ضرورة ضبط ومراجعة قانون حماية التراث الثقافي، واستحداث آليات رقمية لتعزيز الحماية للموروث الثقافي وتوثيقه إلكترونيا، وحفظه من الاندثار والزوال. كلمات مفتاحية: التراث الثقافي، الرقمنة، قانون 98-04، الممتلكات الثقافية، الحماية الرقمية. Abstract: The Algerian legislator was intereted in the national cultural heritage, and his interest was manifested in the issuance of Law No.98-04 on the protection of Cultural Heritage in 1998, which included general rules that define the legal framework for valuing and preserving cultural heritage.Howerver, with the technological development, the so-called digitization of cultural heritage appeared, which resulted in Creating a legislative vacuum in the development of digital protection, as the general rules of this law have become unable to keep pace with the rapid changes in information technologies, and their transition from the traditional field to the digital field, which calls the legislator to the need to control and review the cultural heritage protection law, and to develop digital mechanisms to enhance protection for hertage Cultural and electronic documentation,and preservation from extinction and demise
