تحقيق إرشاد الواقف على تحقيق معنى وخصصت نية الحالف لأحمد بابا بن أحمد بن أحمد بن عمر التنبكتي (1036 هـ / 1627م)

Résumé: يعتبر مختصر خليل ابن إسحاق أهم مختصر في الفقه المالكي، بالغ مؤلفه في الاختصار إلى درجة أن وصل الأمر إلى كونه أشبه بالألغاز أحيانا، مما جعل العلماء ينكبون عليه تعليقا وشرحا وتحشية، قصد تقريبه إلى الأفهام. لقد ساهم أحمد بابا التنبكتي في هذه الجهود، إما بشرح مقاطع منه، أو بشرحه، أو بتحشيته. ويندرج هذا العمل الذي قمنا به في إطار إبراز جهود أحمد بابا في هذا المجال؛ وذلك بتحقيق أحد شروحه على مقاطع من المختصر، وهو شرحه المسمى إرشاد الواقف على تحقيق معنى وخصصت نية الحالف Mukhtasar of Khalil ibn Ishaq (d. 1314) is undoubtedly the most famous of the summaries of the Maliki rite, a book condensed to the point of becoming an enigma difficult to decipher for the ulema, and even more so for the learners. This is why many scholars have given him many comments, footnotes, annotations, etc., in order to make it accessible. Ahmed Baba's work on this book falls within this framework. This article is a critical edition of one of commentaries of Ahmed Baba (d, 1627) on Mukhtasar of Khalil, the commented passage is related to the elements that specify the intention of the on talking an oath. Our job is to collate the documents in order to correct the gaps and to write the critical apparatus.
