Résumé: تعالج المذكرة موضوع هام يندرج تحت باب مباحث الأحوال الشخصية، وهو:"" أثر العرف في حقوق الزوجين"": دراسة مقارنة بين الشريعة الإسلامية والقانون الجزائري، تتمحور إشكاليته الرئيسية حول : كيف يؤثر العرف في تقرير حقوق الزوجين في الفقه الإسلامي والقانون الجزائري ؟ وقد جاء الموضوع في فصلين، خصص الأول الدراسة: الأساس التشريعي للعرف وحقوق الزوجين، والثاني لدراسة دور العرف في تقرير حقوق الزوجين في الفقه الإسلامي والقانون الجزائري."Abstract The title of this dissertation, ""The impact of custom on the rights of two spouses,"" falls under personal status studies. It discussed the topic as ""a comparative study between Islamic and Algerian law."" The problem with it is, ""How does custom affect determining spouses rights in Islamic jurisprudence and Algerian law? The dissertation is divided into two chapters: The first chapter contains the legislative basis of custom and the rights of spouses. the second chapter: the role of custom in determining the rights of spouses in Islamic jurisprudence and Algerian law. The main results of this research include: Accustom has an impact on a spouse's rights, especially material ones. Suggestions and recommendations adding legal material stipulates customary rights for spouses.
