التدليس كأساس للإخلال بالإلتزام بالإعلام في العقد التجاري الإلكتوني

Résumé: في ظل عدم التوازن الذي أفرزه التطور التكنولوجي والتجارة الالكترونية خاصة مع تطور السلع والخدمات، والتفاوت في المعرفة والخبرة بين الموردين والمستهلكين، لجأت التشريعات في سبيل سد هذه الفجوة إلى إلزام المورد الالكتروني بإعلام المستهلك الالكتروني بكافة المعلومات والبيانات عن السلعة أو الخدمة محل التعاقد من أجل تنوير وتبصير المستهلك الالكتروني حتى يقدم على التعاقد برضا مستنير، وإن الإخلال بهذا الالتزام سواء باستعمال الكذب و التضليل أو بالكتمان التدليسي للمعلومات يسبب تعيب إرادة المستهلك الالكتروني بالتدليس وهو ما يثير مسؤولية المورد الالكتروني ويعطي المستهلك الالكتروني في المقابل الحق في إبطال العقد والتعويض.Under the imbalance created by technological development and electronic commerce, especially with the development of goods and services, and the disparity in knowledge and experience between suppliers and consumers, legislation has resorted to obligating the electronic supplier to provide the electronic consumer with all information and data about the good or service subject of the contract in order to enlighten the consumer and help him to willingly enter into a contract. Hence, in case of any breach of this obligation, whether by false and misleading claims or by fraudulent concealment with the intent to deceive or defraud the electronic consumer, the electronic supplier shall bear the breaching responsibilities, and the consumer is hereby granted the right the contract annulment and remedies.
