الحجز التحفظي وفقا لقانون الإجراءات المدنية و الإدارية الجزائري
Résumé: تختص هذه الدراسة بالبحث في إجراءات الحجز التحفظي باعتباره إجراءً وقائيا يقوم به الدائن بواسطة المحضر القضائي، متى توفّرت مسوّغات إثبات الديّن، وقد تمّ في الفصل الأولالبحث في الأحكام العامة المتعلقة بالحجز التحفظي، والتي تبيّن خصوصيته وتميّزه عن باقي الأحكام المشابهة له، وتشرح الصورة القانونية للأركان المشكلة للحجز التحفظي (الحاجز، المحجوز، المحجوز عليه). أمّا الفصل الثاني فيهتم بالبحث في إجراءات توقيع الحجز التحفظي، والآثار المترتبة عنه، وكيف يتحوّل الحجز التحفظي إلى حجز تنفيذي. Summary: This study is concerned with examining the procedures of precautionary attachment as a preventive measure carried out by the creditor through the judicial record, whenever there are documents proving the debt. legal photo For the constituent elements of the precautionary seizure (the barrier, the seized, the seized).As for the second chapter, it is concerned with researching the procedures for signing the precautionary attachment, its implications, and how the precautionary attachment turns into an executive reservation.
