أثر تعديل القواعد الاجرائية على المراكز القانونية للخصوم في الخصومة المدنية

Résumé: تهدف هذه الدراسة إلى تسليط الضوء حول مسألة تأثير تعديل قواعد قانون الإجراءات المدنية على المراكز القانونية للخصوم في مجال الخصومة المدنية، وقد توصلت الدراسة إلى أن المشرع الجزائري حل مشكلة تنازع القوانين باعتماده على مبدأ الأثر الفوري للقانون الجديد كأصل عام، مستثنيا من ذلك الآجال وقواعد الاثبات، باعتبارهما تؤثران على المراكز القانونية للأطراف المتخاصمة، فيطبق على الآجال مبدأ الأثر المستمر للقانون القديم التي بدأت في ظله، دون النظر ما إذا كان القانون الجديد قلص المدة أو أطالها، ويطبق على قواعد الاثبات القانون القديم الذي أعد فيه الاثبات أو كان من المفروض إعداده. لكن يعاب على المشرع أنه لم يستثن بعض الحالات من تطبيق الأثر الفوري للقانون الجديد تاركا مهمة الاجتهاد فيها للفقه والقضاء. This study aims to shed light on the issue of the effect of amending the rules of the Civil Procedure Code on the legal positions of the litigants in the field of civil litigation. The study concluded that the Algerian legislator solved the problem of conflict of laws by relying on the principle of immediate effect of the new law as a general asset, excluding the deadlines and rules of evidence. As they affect the legal positions of the disputing parties, the principle of the continuous effect of the old law under which it began is applied to the deadlines, without considering whether the new law shortened or prolonged the period, and the old law in which the evidence was prepared or was supposed to be prepared is applied to the rules of evidence. However, the legislator is blamed for not excluding some cases from applying the immediate effect of the new law, leaving the task of jurisprudence in them to jurisprudence and the judiciary
