الثبات التشريعي كضمان لحماية المستثمر الأجنبي

Résumé: تقوم الدول المضيفة للاستثمار الأجنبي بإحداث تغييرات في تشريعاتها، قصد مواكبة التطورات الاقتصادية السريعة التي يشهدها العالم وتحقيق التنمية المنشودة،إلا أن ذلك قد يؤدي إلى زعزعة ثقة المستثمر الأجنبي وتزايد مخاوفه نتيجة اختلال التوازن الاقتصادي للعقد المبرم بين الطرفين على نحو يؤدي إلى الإضرار بالطرف الأجنبي،وهو ما دفع العديد من الدول إلى تعهدها والتزامها بعدم المساس بالنظام القانوني للعقد،ووضع ما يعرف بشرط الثبات التشريعي في عقودها مع المستثمرين الأجانب، بهدف تثبيت الدور التشريعي للدولة ، وتأمين حماية للمستثمر طيلة مدة تنفيذ العقد. Abstract:Countries hosting foreign investment change their legislation , in order to achieve the desired development and to keep up with the quick economic developments which the world is witnessing , however, this may undermine the confidence of the foreign investor and his fears grew as a result of the economic imbalance of the contract in a manner leading to harm to the foreign party , which has led many countries to pledge and its commitment not to prejudice the legal regime of the contract , and imposing what is known as the requirement of legislative stability in its contracts with foreign investors, and the goal is to establish the legislative role of the State and to provide protection to the investor throughout the period of execution of the contract.
