التراث المشترك للإنسانية في قانون البحار، بين ثورية المفهوم وردة التطبيق

Résumé: ملخص: هذا المقال المتخصص في القانون الدولي للبحار يبحث عن إبراز مفهوم مستجد في القانون الدولي لا يزال يبحث عن تطبيقاته، وسنحاول عبر المنهج الوصفي والاستدلالي مع حضور المنهج التاريخي في المواضع التي يستلزمها إبراز أوجه ثورية هذا المفهوم وما جاءت به وما عبرت عنه قيمته الإنسانية التي سرعان ما انتكست ووقعت فيه ردة. فكانت جرأة مفهوم التراث المشترك للإنسانية أكبر معبر عن تطور القانون الدولي؛ وقبوله لكيان قانوني جديد يسمح باستغلال الثروات الموجودة في قيعان البحار والمحيطات، ثروات معدنية رهيبة ناهزت ما هو موجود في اليابسة؛ ولكن هذه الثروات وحجمها جعلت الصراع عليه يخرج من دائرته الإنسانية التكافلية التضامنية إلى دائرة شرسة تجارية رأسمالية، نقل على إثرها هذا المفهوم الذي عبرت عنه اللائحة 2749 والجزء الحادي عشر من اتفاقية الأمم المتحدة لقانون البحار لسنة 1982 نقلة غيرت فلسفته عبر ما يعرف باتفاق 28 جويلية 1994. الكلمات المفتاحية: التراث؛ المشترك؛ الإنسانية؛ قانون للبحار؛ اتفاق. Abstract: The present paper focuses on International Law of the sea. It investigates a new concept with its multifaceted tools. The study utilizes an inductive descriptive approach with a tinge of historical perspective highly needed when mention is made to its revolutionary and human values that have experienced regressions lately. It was the boldness of the concept of the common heritage of humanity largest expression of the development of international law; and its acceptance of a new legal entity allowed to exploit the resources located on the bottom of the seas and oceans The conflict upon which has acceded the principles of living together and the tenet of solidarity, to a cut-throat competitive of capitalist states. This resulted in the issuance of 2749 resolution from the eleventh item of the United Nations agreement on seas of 1982.
