Résumé: تتناول هذه الدراسة التعامل مع الاجنبي(الاستثمار نموذجاً)، من حيث الشروط، الضوابط، الأهداف، حيث تعريف ووجوب الاستثمار، ثم ماهية وشرعية التعامل مع الاجنبي المستثمر، وشروط ودواعي هذا التعامل، ثم الضوابط التي تحكم التدفقات الاجنبية ومن ثم الاهداف التي يرجي تحقيقها من وراء التعامل مع الاجنبي. ولقد خرجت هذه الدراسة بعدة نتائج منها، جواز التعامل مع الاجنبي وإتاحة الفرصة للأجنبى بالاستثمار في آراضي المسلمين، ما دام جر نفعاً للمجتمع، بل إن منهج الإسلام يضمن للأجنى المستثمر استثماراً مربحاً آمناً وفق قواعد عامة تحكم وتضبط هذا الاستثمار، والتي ترقى لتصبح أهدافاً عامة يسترشد بها الى تنمية شاملة. Abstract The study tackles the way deal with the foreign investor, in term of conditions ,aims and regulation . it identifies the transactions with the foreign investor , including the indications , and conditions on that hind deal . this is besides the principles of control that are set to organize this investment, with consideration to the organizing of foreign currency flowing for achieving aims of deal. The study comes up with a number of results, of which is the Islamic permission for the foreign investment as far as that brings about benefits for the society, It is worth mentioning that Islamic investment regulation and methods provides guarantees for the foreign investor to have sate and profitable investment in accordance with the rules that control the invest mental process, for achieving a comprehensive development.
