النظام القانوني للتسرب في التشريع الجنائي الجزائري

Résumé: لقد كان للثورة التكنولوجية الرقمية الحاصلة في العالم أثر في تصاعد نسبة ارتكاب الجرائم واستغل منفذوها هذه القفزة العلمية لتنفيذ أغراضهم الاجرامية فكان لزاما على المجتمع أن يساير التشريع مع كل المستجدات المحلية وحتى العالمية، وبما أن الأساليب الكلاسيكية في البحث والتحري لا تفي الغرض المطلوب في الوقاية من الجريمة والوقاية منها، مما أدى الى ايجاد أساليب حديثة لمواجهة الجريمة المنظمة العابرة للحدود، وفي موضوعنا هذا نتطرق إلى إحدى الوسائل أو الطرق الحديثة التي استحدثها المشرع الجزائري في قانون الاجراءات الجزائية بالتعديل في 20/12/2006 وهو اجراء التسرب أو الاختراق. The digital technological revolution taking place in the world had an impact in the escalation of the crime rate and its perpetrators took advantage of this scientific leap to implement their criminal purposes, so society had to keep pace with the legislation with all local and even global developments, and since classic methods of research and investigation do not fulfill the required purpose in crime prevention , which led to finding modern methods to confront transnational organized crime, and in this matter we touch on one of the modern methods that the Algerian legislator has introduced in the Criminal Procedure Law by the amendment on 12/20/2006, which is the procedure of infiltration.
