أساس المسؤولية المدنية المهنية The Basis Of Professional Civil Liability

Résumé: ملخص: تعتبر المسؤولية المدنية الجزاء المترتب عن الإخلال بالالتزامات الملقاة على عاتق الشخص المكلف بأدائها وقد أخذت حيزا واسعا من الإهتمام على اعتبارها من مصادر الإلتزام، وقسمت الى نوعين المسؤولية التقصيرية والعقدية. وتظهر أهمية البحث عن الأساس الذي تقوم عليه المسؤولية المهنية التي ظهرت بظهور الحوادث المهنية و إصابات العمل والتي يصعب معها إثبات الخطأ المهني، لذا كان لا بد من ايجاد حل من أجل تعويض المضرور الذي يتعذر عليه إثبات الخطأ، فظهرت المسؤولية المدنية القائمة على أساس الضرر، والتي تجد تطبيقاتها في المجال المهني. الكلمات المفتاحية: المسؤولية؛ الخطأ المهني؛ الضرر؛ العلاقة السببية؛ التعويض. Abstract: Civil liability is the penalty for breaching the obligations of the person responsible for its performance and has taken a wide range of attention as a source of obligation, divided into two types of liability. The importance of seeking the basis for professional responsibility that has emerged with the emergence of professional accidents and work injuries, which are difficult to prove professional error, is evident, so a solution had to be found in order to compensate the injured who could not prove the error, and the civil liability based on damage, which finds its applications in the professional field.
