منهج النقد الفقهي عند ابن العربي وأثره في خدمة المذهب المالكي من خلال كتابه: "القبس" أسس منهجية ونماذج تطبيقية

Résumé: ملخص- بذل الفقيه أبو بكر بن العربي في كتابه القبس جهودا كبيرة في نقد الفقه المالكي، بهدف خدمته وإحيائه والتأصيل له، وتنقيته من المدخول وتنقيحه من الآراء الشاذة والروايات الضعيفة، بعد أن ساد في عصره التقليد والتعصب المذهبي. ولما كان إبرازُ معالم منهج هذا الفقيه في النقد الفقهي، وبيانُ أثره داخل المذهب له أهمية كبيرة في الإسهام في ضبط قواعد النقد البناء، والتحرر من التقليد الأعمى، وإثراء المذهب وخدمته تأصيلا وتفريعا، ارتأيت البحث في الموضوع، حيث قمت من خلاله بالكشف عن سمات منهج ابن العربي في النقد الفقهي وأسسه، وتفسير الروافد والدوافع التي أثمرت عقليه النقدية، إضافة إلى إبراز جهوده في النقد الفقهي من خلال كتاب القبس ومدى أثرها في خدمة المذهب المالكي. وقد خلصت هذه الدراسة في نهايتها إلى جمموعة من النتائج منها: مدى أهمية عقلية ابن العربي النقدية في خدمة المذهب المالكي تجديدا واجتهادا، كنصرته وإبراز صحة مسائله، وتصحيح رواياته. Abstract In his book Al-Qabas, the jurist Abu Bakr bin Al-Arabi made great efforts in criticizing the Maliki jurisprudence, with the aim of serving it, reviving it and rooting for it, purifying it from the income and refining it from abnormal opinions and weak narrations, after tradition and sectarian fanaticism prevailed in his time. Since highlighting the features of this jurist’s approach to jurisprudential criticism, and explaining its impact within the madhhab, is of great importance in contributing to controlling the rules of constructive criticism, liberation from blind imitation, and enriching the sect and serving it as rooting and reprimanding, I decided to research the subject, through which I revealed the features of the approach. Ibn al-Arabi in jurisprudential criticism and its foundations, and the interpretation of the tributaries and motives that resulted in the monetary mentality, in addition to highlighting his efforts in jurisprudential criticism through the book of al-Qabas and the extent of its impact in serving the Maliki school of thought. At the end of this study, this study concluded with a set of results, including: the importance of Ibn al-Arabi's critical mentality in serving the Maliki school of thought in renewal and diligence, such as supporting it, highlighting the validity of its issues, and correcting its narrations
