شرح غريب الحديث عند الإمام الترمذي في كتابه الجامع وأثره في اختياراته الفقهية – نماذج من البيوع المحرمة -

Résumé: كان لعلم غريب الحديث صدى واسع في مصنفات المحدثين والفقهاء، حيث أورى له العلماء عناية بالغة في كتبهم، وبعضهم أفرد مصنفات خاصة بهذا العلم، ومن المصنفات التي اعتنت بشرح غريب الحديث: كتاب الجامع للإمام الترمذي رحمه الله، فقد شرح فيه ما استشكل من ألفاظ في الأحاديث، بطريقة مختصرة وسهلة للباحث في هذا الشأن، وقد اعترضنا في هذا الموضوع إشكالية تخص اختيارات الترمذي الفقهية في شرحه لغريب الحديث من خلال كتابه الجامع، وفي هذا المقال انتقيت البيوع المحرمة من الكتاب، محاولا بيان أي المذاهب الأربعة مال إليه الإمام الترمذي في شرحه لغريب الحديث. The science of unfamiliar Hadith has had such a wide resonance in the works of Hadith scholars and jurists, as scholars paid great attention to it in their books, and some of them devoted special works to this science. Among the works that focused on explaining the unfamiliar hadiths was Kitab Al-Jami’ by Imam Tirmidhi, may God have mercy on him. In it, he explained the problematic terms in hadiths in brief and easy way for the researcher in this regard. We have encountered in this topic a problem related to Al-Tirmidhi’s jurisprudential choices with regard to his explaining the unfamiliar hadiths through his book Al-Jami’. And in this article, I have selected prohibited transactions from the book, trying to explain which of the four schools of doctrines Imam Tirmidhi leaned towards in his explanation of the unfamiliar hadiths.
