التعويض عن الطلاق التعسفي بين الفقه الإسلامي والقانون الوضعي

Résumé: إن الطلاق التعسفي ىو اساءة استخدام الرجل حقو في ايقاع الطلاق الموكل لو شرعا بحيث يطمق عمى كل طلاق ..... بو الزوج وتأذن منو الزوجة بإلحاق الضرر بيا ولقد خصصنا بحثنا ىذا في التعويض عن ىذا الطلاق التعسفي فمن الفقياء من قال بالتعويض لمزوجة وذلك تعويضا عما لحقيا من ضرر ومنيم من قال بعدم التعويض لأن الطلاق مشرع لمزوج ومن حقو، أما القانون فقد أقرن جميع القوانين الوضعية بالحكم بالتعريض لمزوجة إذا طمقت تعسفا بالضرر. تقدير ىذا التعويض حسب حالة الزوجة وما لحقيا من ضرر ويكون حسب سمطة القاضي ويختمف من دولة إلى أخرى. كل ىذا بغرض الحد من ىذه الظاىرة والحفاظ عمى الحياة الزوجية . The arbitrary divorce is abuse of the man the right to divorce entrusted to him religiously so called each divorce ..... by husband and authorize him to the wife of harming them and I have dedicated our research in compensation for this arbitrary divorce, it is the scholars of the said compensation to the wife as compensation what is right for the damage and some of them said no compensation because the lawmaker divorce the husband is entitled, but the law has been governing runs down to the wife horny all the man-made laws if divorced arbitrarily damage. This estimate compensation according to the case of the wife and the subsequent damage and be by the judge's authority and varies from state to state. All this in order to reduce this phenomenon and mamaintain the marital life.
