التغذية القسرية للأسرى الفلسطينيين المضربين عن الطعام في السجون في الفقه الإسلامي والقانون الدولي

Résumé: تناولت هذه الدراسة التغذية القسرية للأسرى الفلسطينيين المضربين عن الطعام في السجون في الفقه الإسلامي والقانون الدولي، هادفة إلى التعرف على ماهية التغذية القسرية وإضراب الأسير عن الطعام، وطبيعة هذه التغذية وكيفية حصولها، حيث تم الوقوف على حقيقة التغذية وصورها ورأي القوانين الدولية والتشريعات الإسلامية بخصوص ذلك، ثم عالج البحث خطورة القيام بأسلوب التغذية القسرية على حياة الأسرى المضربين عن الطعام وحقوقهم وكرامتهم، من المنظورين الشرعي والقانوني، وذلك بنصوص واضحة في كل منهما، وقد ظهر أن التشريعات الإسلامية والدولية قد اهتمت بالأسير وكرامته الإنسانية، وعملت كذلك على رعاية حقوق الأسير وتنظيم التعامل معه بالإحسان وفق مظاهر وتفصيلات وردت في هذا البحث. This study deals with the forced feeding of Palestinian prisoners on hunger strike in prisons in Islamic jurisprudence and international law, with the aim of identifying the nature of forced feeding and hunger strikes, the nature of this feeding and how it is obtained, where the reality of nutrition and its images and the opinion of international laws and Islamic legislation regarding this were examined Then the research dealt with the danger of using the method of forced feeding on the lives of the hunger striking prisoners, their rights and dignity, from the legal and legal perspectives, with clear texts in each of them, and it appeared that Islamic and international legislations have taken care of the prisoner and his human dignity, and has also worked to take care of the prisoners' rights and organize dealing With charity, according to the appearances and details mentioned in this research.
