الطبيعة القانونية للمسؤولية المدنية عن الأخطاء الطبية

Résumé: إن الاطباء مطالبون بتقديم افضل النتائج المرجوة من تدخلاتهم الطبية شأنهم في ذلك شأن باقي المهنيين، حيث صار الفرد حريصا على الإستفادة من الأعمال الطبية دون أن يقبل مضاعفاتها أو مخاطرها، ولا يثوانى عن مساءلة الطبيب إذا لم يتحقق مراده من هذا التدخل الطبي. إن المسؤولية المدنية عن الأخطاء الطبية لم يرد من شأنها نص خاص، بل بقيت تخضع للقواعد العامة، غير أن ذلك غير كافي، لأن المسؤولية الطبية هي مسؤولية مهنية، تنشأ عن مخالفة الإلتزامات المهنية التي تتضمن أصول و قواعد مهنة الطب، هذه الالتزامات تشغل كاهل الطبيب تجاه كل مريض يحصل على علاجه، حتى وإن لم يربطه أي عقد، ومن تم فالمسؤولية الطبية تتجاوز التقسيم التقليدي للمسؤولية المدنية. Abstract: (Do not exceed 150 words) Doctors are required to provide the best desired results from their medical interventions, just like other professionals, as the individual is keen to benefit from medical work without accepting its complications or risks, and he does not hesitate to question the doctor if his intention is not achieved from this medical intervention. Civil liability for medical errors was not covered by a special text, but remained subject to the general rules, but this is not sufficient, because medical responsibility is a professional responsibility, arising from a violation of professional obligations that include the assets and rules of the medical profession, these obligations occupy the shoulders of the doctor To every patient who receives his treatment, even if he is not bound by any contract, and thus medical liability goes beyond the traditional division of civil liability.
