النزاع الاداري في ظل النظام الاسلامي

Résumé: :الملخص يعتبر قضاء المظالم هيئة قضائية مستقلة، له اختصاصات قضائية و تنفيذية هذا ما لم يجعل الفقه يستقر عند تعريف واضح و تحديد طبيعته تحديدا دقيقا ،فمنهم من اعتبره قضاء إداري ،و منهم من اعتبره درجة عليا من درجات التقاضي (الاستئناف و النقض) ،و البعض اعتبره قضاء عادي و إداري معا ،أما البعض الآخر فكيفه على أنه مؤسسة عامة للتفتيش العام للدولة الإسلامية، اذ عرفت الجزائر على غرار الدول العربية تطبيق هذا النظام في العهد العثماني إلى حين الاستقلال، بينما نجده قد حظي باهتمام أكبر في عهد الأمير عبد القادر بولايته شخصيا في تحقيق مبادئ العدالة والقانون و السهر على حماية الحقوق و الحريات من تعسف و ظلم الإدارة. Abstract: The judiciary of grievances is considered an independent judicial body, with judicial and executive powers, unless the jurisprudence settles upon a clear definition and precise definition of its nature. He considered it an ordinary and administrative judiciary together, while others described it as a general institution for the general inspection of the Islamic state, as Algeria, like the Arab countries, knew the application of this system during the Ottoman era until independence, while we find that it received more attention during the reign of Prince Abdul Qadir with his mandate personally. In achieving the principles of justice and law, and ensuring the protection of rights and freedoms from the abuse and injustice of the administration.
