الجدل الفقهي بين علماء المغرب الإسلامي-–مسألة ثبوت الشرف من جهة الأم أنموذجا-

Résumé: تزخر كتب النوازل بالكثير من المسائل الفقهية التي كانت محل خلاف وجدل بين فقهاء الغرب الإسلامي، ومن أهم تلك الفتاوى التي أسالت الحبر بين الفقهاء هل يثبت الشرف من جهة الأم أم لا ؟ أمدنا كتب النوازل في بلاد المغرب الإسلامي بأجوبة مختلفة في المسألة ظهر الخلاف فيها حادا بين فقهاء بجاية وتلمسان وفاس وتونس، قدم كل فقيه الأدلة بالنصوص المختلفة والاجتهاد الفقهي في المسألة لإثبات ما ذهب إليه، فعرف القرنان الثامن والتاسع الهجريان الرابع عشر والخامس عشر الميلاديان نقاشا وجدلا بين الفقهاء، فما هي السياقات التاريخية لهذا الجدل الفقهيي ؟ وماهو محتواه؟ وكيف ردت المدرسة البجائية على المدارس التي اختلفت معها في هذه المسألة؟ وماهي الحجج التي وظفها فقهاؤها في مناظرتهم لمخالفيهم ؟ وماا نستنتج من دلك الجدل الفقهي ؟ . ABSTRACT Books on Islamic jurisprudence are filled with numerous legal issues that were subjects of disagreement and debate among the scholars of the Western Islamic world. One of the most significant fatwas that generated extensive discussion among scholars in major centers of learning was whether noble lineage (sharaf) is established through the maternal line or not. Books on Islamic jurisprudence in the Islamic Maghreb provided various answers to this issue, with a sharp divide appearing among the scholars of Bejaia, Tlemcen, Fes, and Tunis. Each scholar presented evidence from different texts and jurisprudential reasoning to support their view. The eighth and ninth centuries AH (14th and 15th centuries AD) witnessed significant discussion and debate among scholars on this matter. What are the historical contexts of this historical debate? What is its content? How did the Bejaia school respond to the other schools that disagreed with it on this issue? What arguments did its scholars use in their debates with their opponents?
