وضع اللغة العربيّة في الجزائر بين القانون و الواقع

Résumé: ملخص: تُعد اللغة العربيّة في الجزائر مبدأ دستورياً تجب حمايته، كما أنها مظهر من مظاهر السّيادة الوطنية و رمز من رموزها، و لذلك فإن المساس بها يعد خرقاً مباشرا لأحكام الدستور، و هي أيضا عنصر من عناصر النظام العام يقع على عاتق السّلطة الإدارية الضّبطية السّهر على حمايتها وعلى القضاء التصدي لكل المخالفات للقوانين المتعلقة بتعميم استعمالها. عملت السّلطة السّياسية في الجزائر منذ الاستقلال على توفير نظام قانوني خاص للغة العربيّة يضمن تعميمها و حمايتها، وقد تبلور هذا النظام في شكل سياسة اصطلح على تسميتها بالتعريب منذ سنوات التسعينات من القرن الماضي، لكن تفعيلها ظلّ ولازال مرتبطاً بإرادة السّلطة السّياسية ومدى جديتها في مسألة اللغة العربية. English Abstract: The Arabic language in Algeria is a constitutional principal that must be protected; it is also an aspect of sovereignty and one of its symbols that the prejudice of it forms a direct breach of the constitution. It is an element of public order, so it must be protected by administrative police authorities and by courts as well against any breaches to the laws of generalization of using of the Arabic language. Since the independence the political power in Algeria tried to provide a legal system to the Arabic language that guarantees its generalization and protection, that policy called Arabization took place in 90th of last century, but it’s in fact more related to the will of the political power and how much is serious in the issue of Arabic language.
