الإجراءات القانونية الواجب اتّباعها لمعاينة حادث العمل

Résumé: ملخص: إنّ حادث العمل هو كل حادث انجرّت عنه إصابة بدنية ناتجة عن سبب مفاجئ وخارجي في إطار علاقة العمل، وفي حالة تحقّق الحادث، وتكييفه على أنّه حادث عمل، يحصل العامل المؤمّن له على أداءات عينية أو نقدية جبرا للعجز الذي أصابه، أو لذوي حقوقه في حالة وفاته، وهو الهدف المراد تحقيقه من خلال البحث في مدى مهنيّة الحادث الذي يقع في بيئة العمل، ومن أجل ذلك، فرض المشرّع الجزائري اتّباع مجموعة من الإجراءات القانونية لمعاينة حادث العمل، والمتمثلة في الإجراءات الإدارية والإجراءات الطبيّة وفقا للقانون 83-13 المتعلق بحوادث العمل والأمراض المهنيّة، هذا بغض النظر عن النقائص الواردة فيه، والتي تتطلّب بعض المراجعة القانونية. Abstract A work accident is any accident that causes a physical injury due to a sudden and external cause occurring at the work relationship. In case that the accident happens and is adopted as to be a work accident, the insured worker will receive, in kind or cash payments, to make up for the disability he or his rightful owners have suffered from in case of his death. It is the aim to be achieved by researching the professionalism of the accident that occurs at his work environment. For this, the Algerian legislator imposed a set of legal procedures for the work accident ascertainment, including administrative and medical procedures in accordance with Law 83-13 bearing work accidents and professional diseases. This is regardless to the shortcomings contained in it, which require some legal review.
