الصلح القضائي في نظام الافلاس في التشريع الجزائري

Résumé: ينتهي الإفلاس والتسوية القضائية إما بالصلح أو بالاتحاد أو تغلق التفليسة مؤقتا لعدم كفاية الأصول، أو تغلق نهائيا لانقضاء الديون، ولا شك في أن الحل الأمثل الذي يجب البحث عنه في حالة التسوية القضائية هو تصالح المدين مع دائنيه. وهو ما جعل المشرع يقر بذلك وأعطى فرصة للمدين المفلس بتقديم اقتراحاته حول الصلح. تتناول دراسة الصلح القضائي باعتباره آلية من آليات تسوية النزاعات في المجال التجاري، كما أنه يعتبر إجراءً من الإجراءات التي تؤدي إلى إنهاء التفليسة وعودة المدين المفلس إلى رأس ماله، حيث يتم التعرض إلى شروط الصلح القضائي، وأهم الآثار المترتبة عليه، للوقوف على الضمانات التي خص بها المشرع الدائنين للحصول على حقوقهم وفقا لمبدأ المساواة، مع التعرض لموقف التشريعات المقارنة، خصوصا التشريع المصري الذي أعطى أهمية بالغة لهذا الموضوع. الكلمات المفتاحية: الإفلاس والتسوية والصلح Abstract Bankruptcy and judicial settlement shall end either by composition or union, or the bankruptcy shall be temporarily closed due to insufficient assets, or shall be permanently closed due to the expiration of debts, and there is no doubt that the best solution that must be sought in the case of judicial settlement is the debtor's reconciliation with his creditors. This made the legislator acknowledge this and gave an opportunity to the bankrupt debtor to submit his proposals on composition. It deals with the study of judicial reconciliation as one of the mechanisms for settling disputes in the commercial field, and it is considered one of the procedures that lead to the termination of bankruptcy and the return of the bankrupt debtor to his capital, where the conditions of judicial reconciliation are addressed, and the most important effects of it, to find out the guarantees that the legislator allocated to creditors to obtain their rights in accordance with the principle of equality, with exposure to the position of comparative legislation, especially the Egyptian legislation, which gave great importance to this subject.
