مكانة التحكيم في حل النزاعات الأسرية

Résumé: يهدف هذا البحث إلى دراسة دور التحكيم في حل النزاعات الأسرية، وذلك من خلال تناول مفهوم التحكيم وآلياته وشروطه في قانون الأسرة الجزائري، وكذلك بيان أهمية التحكيم كوسيلة وقائية وإصلاحية لإنهاء هذه النزاعات. وقد اعتمد الباحث على المنهج التحليلي والمقارن لدراسة الموضوع من منظور قانوني وفقهي. وخلص البحث إلى أن التحكيم يشكل آلية فعالة لفض الخلافات الأسرية، خاصة في ظل تزايد عددها وتعقدها، وأنه يساهم في حفظ حقوق ومصالح الأطراف المتنازعة، وإصلاح علاقاتهم، والحد من آثار الطلاق على المجتمع. كما أوصى الباحث بضرورة تشجيع استخدام التحكيم في حل النزاعات الأسرية، وتوفير الإطار التشريعي والإجرائي المناسب لذلك. The summary in English: This research aimed to study the role of arbitration in resolving family disputes, by addressing the concept of arbitration, its mechanisms and conditions in the Algerian family law, as well as highlighting the importance of arbitration as a preventive and corrective means to end these disputes. The researcher adopted the analytical and comparative approach to study the topic from a legal and jurisprudential perspective. The research concluded that arbitration is an effective mechanism for resolving family disputes, especially in light of their increasing number and complexity, and that it contributes to preserving the rights and interests of the disputing parties, repairing their relationships, and reducing the effects of divorce on society. The researcher also recommended the need to encourage the use of arbitration in resolving family disputes, and to provide the appropriate legislative and procedural framework for that.
