الحماية الجزائية للعلامة التجارية في القانون الجزائري

Résumé: أورد القانون الجزائري حماية قانونية للعلامة التجارية و تشمل الحماية الجزائية والحماية المدنية، إلا أن الحماية الجزائية تقتصر على العلامة التجارية المسجلة فقط دون العلامة غير المسجلة التي يمكن حمايتها عن طريق دعوى المنافسة غير المشروعة. و تشمل الحماية الجزائية المقررة للعلامة التجارية مختلف صور التعدي عليها وهي جريمة تقليد العلامة التجارية ، وجريمة عدم وضع العلامة على السلعة أو الخدمة جريمة وضع علامة تجارية غير مسجلة ، وجريمة الممارسات التجارية غير النزيهة ، وما يتبعه من الغلق النهائي أو المؤقت للمؤسسة و مصادرة الأشياء و الوسائل و الأدوات المستعملة و إتلاف الأشياء المستعملة في المخالفة كما قرر المشرع عقوبات صارمة لمختلف صور التعدي على العلامة التجارية . Abstract : Algerian law provides legal protection for the trademark and includes criminal protection and civil protection, but penal protection is limited to a trademark registered only without the unregistered trademark that can be protected by unfair competition. The trademark protection of the trademark includes various forms of infringement, such as the crime of trademark imitation, the crime of not marking the goods or services as a crime of placing an unregistered trademark, the crime of unfair business practices, The means and tools used and the destruction of the objects used in the violation and the legislator decided to impose severe penalties for various forms of infringement of the trademark.
