حماية حقوق المُدَوِن الإلكتروني في ظل الأمر 03- 05 المتعلق بحقوق المؤلف والحقوق المجاورة.

Résumé: الملخص: في ظل عدم وجود قانون خاص ينظم التدوين الإلكتروني وعدم وضوح صفة المدونين الإلكترونين بسبب الفراغ القانوني لا يزال المدون الإلكتروني يكافح لإيجاد مكانة له في المشهد القانوني الجزائري، لذا تسعى هذه الدراسة لتناول المركز القانوني للمدون الإلكتروني في التشريع الجزائري، وبيان حقوق المدون الإلكتروني، والتدابير التي يوفرها قانون حقوق المؤلف لحماية هذه الحقوق، وذلك قصد توضيح ما إذا كان إصلاح قانون حقوق المؤلف الجزائري يفي بتحديات التدوين الإلكتروني ، أم أن الأمر يتطلب قانون خاص بالمدونين الإلكترونيين. Abstract: In the absence of a special law regulating electronic blogging and the lack of clarity on the character of bloggers because of the legal void, the blogger is still struggling to find his place in the Algerian legal scene, Therefore, this study seeks to address the legal status of the electronic blogger in the Algerian legislation and clarify the rights of the blogger and the measures provided by the copyright law to protect these rights in order to showing whether reforming the Algerian copyright law meets the challenges of blogging, or whether a special law is required for bloggers.
