آفاق وتحديات تطبيق القانون الدولي الإنساني

Résumé: ملخص يواجه القانون الدولي الإنساني تحديات عديدة في أوقات النزاعات المسلحة لدى تطبيقه، وهو أمر مفهوم بحكم أنَّ هذا القانون جاء أصلا لتحقيق توازن هش بين المتطلبات العسكرية للدول خلال الحروب و بين حماية الأشخاص غير المشاركين في القتال. هذا مايدعو لوجوب الاسراع في مراجعة اتفاقياته التي تكاد تصبح اليوم عاجزة عن تنظيم أشكال جديدة من النزاعات لاتشبه تماما تلك الأشكال التقليدية التي وضعت لتحكمها من ناحية الأساليب والوسائل المستعملة خلالها من خلال تحيين القواعد الموجودة أو تبني اتفاقيات جديدة تتماشى أكثر مع التحديات التي تواجه القانون الدولي الإنساني . Summary International humanitarian law faces many challenges in times of armed conflicts when applied, which is understandable given that this law originally came to achieve a fragile balance between the military requirements of states during wars and the protection of people not participating in the fighting. This calls for an urgent review of its agreements, which today are almost incapable of regulating new forms of conflict that are not completely similar to those traditional forms that were set to govern them in terms of the methods and means used through them through updating the existing rules or adopting new agreements that are more in line with the challenges facing international humanitarian law.
