Résumé: تأثر المشرع في تنظيم العلاقة العقدية بالتصور اللاتيني الذي يقوم على فكرة الحرية العقدية ، إلى جانب تأثره بالشريعة الإسلامية التي تعتبر من المصادر الرسمية للقانون ، فتعتبر مبادئ الشريعة الإسلامية مصدر رسمي طبقا للمادة الأولى من القانون المدني ، إلى جانب أن الشريعة الإسلامية هي مصدر مادي للقانون اغترف منها المشرع الجزائري جملة من الأحكام منها نظرية مريض مرض الموت بالرجوع إلى أحكام نظرية مريض مرض الموت وفق القانون المدني ( 408 ـ 409 مدني) والتي وردت وفق الأحكام الخاصة المنظمة لعقد البيع ، التمسنا جملة من التباين ما بين المفهوم الشرعي والمفهوم القانوني .
