رقابة القاضي الإداري على الصفقات العمومية كآلية لحماية حرية المنافسة

Résumé: لما كانت للصفقة العمومية أهمية كبيرة في تنفيذ المشاريع العمومية وانجاز البرامج التنموية،فقد أولها المشرع اهتماما كبيرا تمثل في وضع تنظيم خاص يخضع الصفقة العمومية لإجراءات غاية في التعقيد،وكان لعدم كافية اجراءات الإبرام في الحد من انتهاكات مبادئ المنافسة،سببا في دفع المشرع للبحث عن ايجاد ضمانات فعالة تكرس هذه المبادئ،لأجل إضفاء الثقة لدى المتعاملين المتعاقدين الباحثين عن فرصة للوصول للطلبات العمومية،وتجسيدا لهدا الغرض وجب اخضاع الصفقات العمومية لرقابة القضاء الإداري كألية لتسوية المنازعات الناشئة عن الممارسات المنافية لقواعد المنافسة. الكلمات المفتاحية: المنافسة – القضاء الإداري– الصفقات العمومية - الإعلان – قرارات. Abstract: Since the public deal was of great importance in the implementation of public projects and the implementation of development programs, the legislator attached great importance to it in setting up a special organization subjecting the public deal to very complicated procedures, and the insufficient conclusion of the procedures to limit violations of competition principles, a reason for the legislator to seek to find effective guarantees enshrining these principles, in order to give confidence to contractual dealers looking for an opportunity to reach public demands, and to reflect this purpose, public transactions must be subject to the supervision of the administrative judiciary as a mechanism for settling disputes arising from practices contrary to competition rules.
