التزامات الوسيط المالي في سوق الأوراق المالية

Résumé: ملخص: الوسيط المالي في سوق الأوراق المالية هو شخص أو شركة تساعد الأشخاص على استثمار أموالهم في أسهم شركات مختلفة، و تحتكر شركات الخدمات والوساطة المالية في سوق للأوراق المالية أعمال الوساطة في معاملات هذه السوق.فالمتعامل لا يستطيع بنص القانون الدخول إلى السوق الأوراق المالية وإجراء أي تعامل على أوراق مالية إلا عن طريق شركات وساطة مالية معتمدة رسمياً، فهذه الشركات بهذه الحالة تتمتع بامتياز قانوني خاص بممارسة عمليات الوساطة داخل سوق الأوراق المالية ممّا يعني أن الاستعانة بها في هذا المجال أمر إلزامي للمتعامل وليس أمراً اختيارياً. و نتيجة لدور الفعال الذي تقوم به شركات الوساطة داخل سوق الأوراق المالية، نجد أن مختلف التشريعات اهتمت بالوسيط المالي، و وضعت الأسس التي تبين كيفية عملهم، و كذلك الالتزامات التي يجب على الوسيط المالي احترامها ضمانا لسلامة التعامل بالأوراق المالية، و إبعادها عن التلاعب و الاستغلال و حماية المستثمرين . Abstract: A financial broker in the stock exchange refers to a person or a company that helps individuals in investing their money in shares of different companies. Companies providing services and financial brokerage monopolize the brokerage activities involved in the transactions within this stock exchange .According to the text of the law, individuals cannot access stock exchange or carry out any transactions involving securities without going through officially accredited financial brokerage companies. These companies have a unique legal privilege to perform brokerage .operations in the stock exchange, making their services mandatory for individuals, not optional As a result of the vital role that brokerage companies play in the stock exchange, various legislations have focused on financial brokers, setting forth the foundations and principles that outline their operations, as well as the obligations they must adhere to in order to ensure the integrity of .transactions, prevent manipulation and exploitation, and protect investors
