التبرع بالأعضاء بين التشريع الإسلامي والمقاومة النفسية

Résumé: هدفت هذه الدراسة إلى معرفة موقف التشريع الإسلامي من التبرع بالأعضاء وطريقة فهمه عند أفراد المجتمع ومساهمة ذلك في وجود مقاومة نفسية وعزوف عن التبرع بالأعضاء والأنسجة البشرية. وقد اعتمدنا في هذه الدراسة على المنهج الوصفي وعلى المقابلة النصف موجهة كأداة، وقد تم إجراء هذه الدراسة على 20 حالة من مختلف أنحاء الوطن في فترة زمنية امتدت من (1-7 إلى 15-10 من سنة 2019)، واعتمدنا على تقنية "تحليل المضمون" في تحليل المقابلات، التي توصلنا من خلالها إلى أن غياب ثقافة التبرع بالأعضاء راجعة إلى جهل علمي وكذلك ديني يتمثل في عدم فهم لموقف التشريع الإسلامي من التبرع بالأعضاء، خصوصا في ظل وجود بعض الاختلافات الفقهية حول هذا الموضوع، إضافة إلى الموقف الأسري الذي اتضح أنه غالبا ما يكون رافض على التبرع للغير في حالة كان المتبرع متوفى ما يدفع بعائلته إلى أخد قرارهم حوله، والأخذ بعين الاعتبار موقف الشريعة المعارض للتبرع كحجة على رفضهم، كل ذلك ساهم في ظهور مقاومة نفسية أدت إلى العزوف عن ذلك. This study aimed to know the provision of Islamic legislation about organ donation, and the members's understanding of it by the society, and the contribution of this understanding in the existence of psychological resistance and reluctance to donate human organs and tissues. In this study, we relied on the descriptive approach and the semi-directed interview as a tool. This study was conducted on 20 cases from different parts of the country in a period between (1-7 to 10-15 of 2019), we used the technique of "content analysis" toanalyze the interviews, it is concluded that the absence of the culture of organ donation is due to scientific and religious ignorance represented in the lack of understanding of the Islamic legislation's position about organ donation, especially because of the presence of some jurisprudential differences about this subject, in addition to the family opinion, which turned out to be often refusing the donation to others when the donor is deceased, which make his family taking the decision about him, and taking into account the position of Sharia opposing the donation as an argument for their refusal, all of these contributed in the appearance of psychological resistance that led refuse this matter
