الحرب على الارهاب مبرر للتدخل العسكري

Résumé: الملخص: لقد شنت الحرب على الإرهاب بموجب القرار رقم 1373 الصادر عن مجلس الأمن بتاريخ 28 سبتمبر 2001، هذا القرار الذي أسال الكثير من الحبر حول المفاهيم التي جاء بها، فكان الغموض السمة البارزة فيه، فالقرار جاء ليعطي الحق في استعمال الدفاع الشرعي او تفعيل نظام الأمن الجماعي من خلال التدخل العسكري لمحاربة الإرهاب، ان عدم تحديد مفهوم الإرهاب الدولي أدى إلى عدم استقرار المجتمع الدولي بظهور أعمال انتقامية، فأعطت الحرب على الارهاب شرعية دولية موازية لبعض الدول رغم انتهاكاتها لمبادئ حقوق الإنسان. Abstract The War on Terror was launched by resolution 1373 of the Security Council on September 28, 2001. This decision, which casts a lot of ink on the concepts that came out, was ambiguity. The resolution came to give the right to use the legitimate defense or to activate the system of collective security through the military intervention to fight terrorism. The failure to define the concept of international terrorism led to the instability of the international community with the emergence of reprisals, gave the war on terrorism international legitimacy parallel to some States, despite violations of human rights principles.
