دور الضوابط والمحددات الشرعية في تحقيق كفاءة الأسواق المالية الإسلامية

Résumé: الملخص تهدف هذه الدراسة لبيان الدور الذي تقوم به الضوابط والمحددات الشرعية التي أقرتها الشريعة الإسلامية في تحقيق كفاءة الأسواق المالية الإسلامية، والوصول لأسواق مالية كفؤة وعادلة، وقد تبين من خلال هذه الدراسة وجود العديد من الضوابط الشرعية التي تهدف لضبط هيكل السوق بشكل أساسي، بينما تترك عملية تحديد الأسعار لقوى العرض والطلب دون تدخل خارجي، كما أوضحت هذا الدراسة أيضاً طرق معالجة الكثير من الأسباب التي تؤدي لعدم تحقق كفاءة الأسواق المالية، ومن هذه الضوابط منع تحكم أي طرف باليات السوق، وضمان حرية المشاركين في السوق، وتوفير المعلومات السليمة عن السوق، كما أن هناك ضوابط تهدف لتحقيق عمق السوق المالية. وقد أوصت الدراسة بضرورة وجود اليات واضحة ومقننة لتطبيق المحددات الشرعية للسوق على شكل قوانين يمنع تجاوزها، وتوعية المتعاملين في تلك الأسواق بضرورة الالتزام بالمحددات الشرعية التي تحقق الفائدة لجميع المتعاملين. الكلمات المفتاحية: الأسواق المالية الإسلامية، الكفاءة، الضوابط والمحددات الشرعية. Summary This study aims at demonstrating the role played by the Shariah controls and determinants approved by the Islamic Sharia in achieving the efficiency of Islamic financial markets, and access to efficient and fair financial markets. Determining the prices of supply and demand forces without external interference.This study also showed ways to address many of the reasons that lead to the inefficiency of financial markets.These controls prevent the control of any party by the mechanisms of the market, and ensure the freedom of market participants, and provide sound information on the market. There are also controls designed to achieve the depth of the financial market The study recommended the need for clear and codified mechanisms to apply the determinants of the market in the form of laws to prevent them from exceeding, and sensitizing dealers in those markets the need to adhere to the determinants of legitimacy that benefit all dealers.
